There's a lawsuit going on right now that could knock James Fishback off the ballot for Florida Governor.
This one went to court on July 21st, and it did not go the way most people expected. Jay Collins filed suit back on June 30th challenging whether Fishback actually meets Florida's constitutional requirement that a governor candidate live in the state for 7 consecutive years before the election. The hearing was supposed to run two full days. It wrapped in one, and Fishback's not walking away from this looking good.

Here's why. Fishback registered and voted in Washington D.C. in November 2020. He bought a D.C. condo in 2021 and signed mortgage paperwork requiring him to live there as his primary residence for at least a year. He claimed a D.C. homestead tax deduction, a deduction only available to people who actually live there. His own tax forms listed that D.C. address in 2020, 2021, and 2022, three years running.

His explanation is that an online accountant filled out the forms wrong without his sign off. His lawyer's defense leans on a 2016 Florida driver's license listing a Davie address, and points out Fishback was only 26 when many of these documents got signed. Does that outweighs three years of D.C. tax filings and a signed mortgage. The judge will decide.
Because mail-in ballots are already out, the judge fast tracked the whole thing. Both sides owe the court their proposed orders by 5pm this Friday, and a ruling is expected Monday by 5pm, right before the August 18th primary.
